Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the Flavr mobile app, website, and related services (the “Service”), operated by Flavr (“Flavr”, “we”, “us”, or “our”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
Flavr is available in multiple cities and metro areas, including Montreal, Québec City, Toronto, Ottawa, Miami, and New York, and may expand to additional cities. These Terms apply to your use of the Service in every city where Flavr operates.
1. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the Service. By using the Service, you represent that you meet this requirement and that the information you provide is accurate.
2. Your Account
You are responsible for safeguarding your login credentials and for all activity that occurs under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe pose a risk to the Service or other users.
3. The Service
Flavr is a restaurant discovery and social platform. Features include:
- Social profiles, posts, comments, follows, likes, saves, and lists.
- Restaurant reviews and user-submitted restaurant photos and videos.
- City and metro-based discovery across supported markets (currently including Montreal, Québec City, Toronto, Ottawa, Miami, and New York). You may browse by manually selecting a city or by granting foreground location access.
- Direct messages and group messages between users, including shared restaurant, post, and list references.
- Flavi, our AI assistant, and AI-generated restaurant lists and suggestions.
- Foodmate taste matching and city leaderboards.
- Plans, invites, and RSVPs for outings with friends.
- Business profiles for restaurants and venues, including create, claim, verify, manage, post, and subscriber features.
- Foreground location-based restaurant discovery (optional). On iOS, optional background proximity alerts for saved restaurants may be offered with separate permission.
- Flavr+ paid membership and personal visit/booking notes you manage in the app.
- Optional contact access when you choose to invite friends from your address book.
4. Your Content and the License You Grant
“Your Content” means everything you upload or create on the Service — posts, stories, comments, restaurant reviews, lists, photos, videos, polls, plan content, business profile materials, and user-submitted restaurant media.
You retain ownership of Your Content. Flavr does not claim copyright ownership of it.
By posting Your Content, you grant Flavr a non-exclusive, worldwide, royalty-free, perpetual, irrevocable, transferable, and sublicensable license to host, store, cache, use, reproduce, modify (for formatting and display), adapt, publish, translate, publicly display, distribute, and promote Your Content in connection with operating, providing, and promoting the Service. This allows us to display your posts in feeds, your reviews on restaurant pages, and to feature content in promotional materials.
You represent that you own or have the necessary rights to Your Content and that it does not violate any law or third-party right.
5. Acceptable Use
You agree not to:
- Post content that is illegal, hateful, harassing, threatening, sexually explicit, or that infringes others’ rights.
- Post spam, fake reviews, impersonate others, or misrepresent your affiliation with a person or restaurant.
- Harass, threaten, or send unwanted or abusive messages to other users.
- Create, claim, or manage a business profile you are not authorized to represent.
- Submit false, misleading, or outdated business information, fake verification documents, or manipulated menus, hours, or photos.
- Attempt to disrupt, reverse-engineer, scrape, or gain unauthorized access to the Service.
- Misuse Flavi AI to generate harmful, deceptive, or infringing content.
- Manipulate rankings, Foodmate signals, leaderboards, reviews, or engagement through fake accounts or coordinated abuse.
6. Direct Messaging
Flavr lets you send direct messages and group messages to other users, including shared restaurant, post, and list references. Messages are visible only to the participants of a given conversation.
You may delete a conversation from your own inbox at any time. Deleting a conversation removes it, and the messages in it up to that point, from your view only — it does not delete the conversation for other participants, and it cannot be undone. If a conversation you deleted receives a new message afterward, it will reappear in your inbox, showing only messages sent from that point forward.
You may leave a group conversation at any time; this removes you from the group but does not delete the group or its message history for remaining members.
We may retain message records, including messages from conversations you have deleted or left, as needed to investigate reports of abuse, enforce these Terms, and maintain the safety of the Service.
7. Moderation, Reporting, and Blocking
We provide tools to report content and to block other users. Blocking a user prevents further messages between you and that user. We may review, remove, or restrict content and accounts that violate these Terms or our Community Guidelines, at our discretion. We do not pre-screen all content and are not responsible for user-generated content, but we act on reports and enforce our rules to keep the community safe.
8. Third-Party Content and Services
Restaurant listings, hours, photos, ratings, and other venue information may come from third-party sources, business owners, and user contributions. We do not guarantee that this information is accurate, complete, or up to date in any city where Flavr operates.
The Service may link to third-party websites or services. Flavr is not responsible for the content, policies, or practices of those third parties. Your use of third-party services is at your own risk and subject to their terms.
Personal visit and booking notes you save in Flavr are for your own reference. They do not confirm a reservation with any restaurant unless you have separately arranged that directly with the venue.
Plans and RSVPs are coordination tools between users. They do not create a binding reservation with a restaurant unless arranged separately with the venue.
9. Business Accounts and Restaurant Listings
Flavr lets authorized restaurant owners and representatives create a new venue page, claim an existing listing, request verification, manage storefront details (including hours, menu, media, and fulfillment options), post as the business, and notify subscribers when the business is verified.
By creating, claiming, or managing a business profile, you represent that you are the owner or an authorized representative of that business, that the information you submit is accurate and lawful, and that you have the rights to use any trademarks, logos, photos, and menu content you upload.
Verification indicates that Flavr has reviewed ownership or authorization materials you provided. It is not an endorsement of food quality, safety, hygiene, pricing, accessibility, or compliance with local health, licensing, or advertising laws in any city.
You are solely responsible for keeping your business information accurate and current, for complying with applicable laws in every city where your venue operates or advertises, and for any offers, promotions, or statements you publish on Flavr.
Flavr may reject, suspend, unverified, transfer, or remove a business profile or claim if we reasonably believe information is false, unauthorized, outdated, abusive, or otherwise harmful to users or the Service.
Business posts and subscriber notifications must follow these Terms and our Community Guidelines. Do not use business tools to spam users, mislead customers, or suppress honest reviews.
Deleting your personal Flavr account does not automatically delete a public restaurant listing you manage. Contact support@flavr.ca to transfer ownership or request removal.
10. Flavr+ Subscriptions
Flavr+ is an auto-renewing subscription sold through the Apple App Store and Google Play. Payment is charged to your app-store account at confirmation of purchase. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period.
You manage and cancel your subscription through your App Store or Google Play account settings — not within Flavr. Deleting your Flavr account does not automatically cancel your Flavr+ subscription; you must cancel it through the app store. Refunds are handled by the app stores under their respective policies.
11. Account Deletion and Anonymization
You may delete your account at any time from within the app. Flavr uses an anonymization model rather than full content erasure.
When you delete your account, we remove your login access and personal identity — authentication credentials, email address, phone number, profile information, and private data such as saved restaurants, personal booking notes, follows, and preferences. Your email and phone number are released so they may be used to register a new account in the future.
Your public contributions — posts, stories, comments, restaurant reviews, publicly shared media, and likes — are retained in anonymized form, attributed to “Deleted User” with a default avatar and no accessible profile. This preserves the integrity of public conversations and restaurant review history while severing the link between that content and your identity.
12. Flavr Content and Intellectual Property
The Service — including the Flavr name, logo, software, design, and all content we create — is owned by Flavr or its licensors and protected by intellectual-property laws. We grant you a limited, personal, non-transferable license to use the Service for its intended purpose.
13. Copyright and Intellectual Property Complaints
If you believe content on the Service infringes your copyright or other intellectual-property rights, contact support@flavr.ca with: (a) a description or link to the content, (b) proof that you own the rights or are authorized to act on the owner’s behalf, and (c) your contact information. We may remove content and terminate accounts of repeat infringers.
14. AI Features
Flavi AI, Foodmate suggestions, and AI-generated lists are provided for convenience and may be inaccurate or incomplete. They do not constitute professional advice. Verify important details (hours, availability, dietary suitability, allergens) directly with the restaurant before relying on them.
15. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or that content (including restaurant data, business profile information, hours, menus, photos, and user reviews) is accurate or reliable in any city.
Flavr is not a party to transactions between users and restaurants. We are not responsible for food quality, food safety, allergies, service quality, pricing, reservations made outside Flavr, or compliance with local health and licensing rules.
16. Limitation of Liability
To the maximum extent permitted by law, Flavr will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill, arising from your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of the amount you paid us in the 12 months before the claim or CAD $50.
17. Indemnification
You agree to indemnify and hold Flavr harmless from any claims, damages, or expenses (including reasonable legal fees) arising from Your Content, your use of the Service, your business profile or listing (if any), or your violation of these Terms or any law or third-party right.
18. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes, and your continued use of the Service after changes take effect constitutes acceptance.
19. Governing Law
These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada, without regard to conflict-of-laws principles. If you use the Service from another Canadian province or from the United States (including Miami or New York), you remain responsible for complying with local laws that apply to you, and nothing in these Terms limits non-waivable consumer rights you may have under the laws of your place of residence.
20. Severability
If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.
